Welcome to AMIGO TOURS. This website: https://amigotours.com/ (the “Website”) is owned, operated and/or managed by Operadora Arozarena, S.A. de C.V., a company duly incorporated and validly existing in accordance with the laws of the United Mexican States (“Mexico”), Amigo Group Europa, S.L., a company duly incorporated and validly existing in accordance with the laws of the Kingdom of Spain, with address at Pasaje Bisbal number 6, 1st Floor, 28028, Madrid, Spain with NIE: B87468732 (“Spain”), Amigo Tours New York, LLC, a company duly incorporated and validly existing in accordance with the laws of the United States of America (“United States”) and Amigo Tours LTD, a company duly incorporated and validly existing in accordance with the laws of the United Kingdom of Great Britain and Northern Ireland (“United Kingdom”), and Amigo Tours Japan GK, a company duly incorporated and validly existing in accordance with the laws of Japan (each of them, for the purposes of this document and individually, “AMIGO TOURS”, and according to the jurisdiction where the SERVICES offered through the Website are provided) and is available to users worldwide.

AMIGO TOURS offers through the Website various hospitality, guided tourism, transportation, experiences, as well as tickets to monuments, ruins, temples, museums, locations, among others and in different countries (hereinafter, the “SERVICES” as modified, added to or restated from time to time through the Website).

Your use (i) as a visitor to the Website; (ii) as an individual acting on your own behalf or as a legal entity acting personally; or (iii) as an individual or legal entity acting on behalf and for the account of third parties (“You”) of the Website and the contracting of any of the SERVICES, is expressly conditioned upon acceptance of these Terms and Conditions (the “Terms and Conditions”), expressing your express consent thereto and being obligated to transmit these Terms and Conditions to any person who benefits from or uses the SERVICES contracted through the Website and confirmed by the applicable AMIGO TOURS entity through a service order confirmation sent to the email address You indicate on the Website or displayed on it (a “Confirmed Booking”).

FIRST. DECLARATION OF LEGAL AGE AND CAPACITY. By accessing and using this Website, You declare under oath and guarantee that You are at least 18 years of age (or the legal age of majority in your jurisdiction of residence) and that You have the capacity to bind yourself and contract the services offered by AMIGO TOURS on the Website and that You will use the Website in accordance with these Terms and Conditions and that You will only use it to make bookings on your own behalf or on behalf of third parties for whom You may legitimately act, with You being responsible for the Terms of Use that apply to bookings made on behalf of third parties, including with respect to any rule or restriction. You declare under oath that all information You provide on the Site is true, accurate, complete and current.

This Website is not intended for minors, and we do not intentionally collect personal information from minors. If You do not meet this requirement, You must refrain from using the Website. In the event that we discover that we have collected personal information from a minor without verification of parental or legal guardian consent, we will immediately delete such information from our records. If You are a parent or guardian and believe that your child has provided us with personal information, please contact us so that we may take the necessary measures.

SECOND. ACCEPTANCE AND CONSENT. Prior to the payment of your Confirmed Booking, we will ask You to accept these Terms and Conditions. Such acceptance shall constitute the full understanding and a legal and binding agreement between You and AMIGO TOURS regarding the SERVICES that You have contracted through a Confirmed Booking.

If You have contracted one or more SERVICES and/or obtained a Confirmed Booking in the name and on behalf of third-party beneficiaries of the SERVICES, it is your sole and exclusive responsibility to inform such third-party beneficiaries of these Terms and Conditions. You are jointly and severally liable with said third parties regarding compliance, as well as for any action or omission of such third parties, with these Terms and Conditions and AMIGO TOURS.

THIRD. INTERMEDIARY. You acknowledge that certain SERVICES offered through the Website or experiences associated with your Confirmed Booking are provided or operated by individuals and/or legal entities unrelated to AMIGO TOURS, such as land, water or air transportation services, hospitality, hot air balloon travel operators, hospitality, experiences, among others. Such services associated or connected to your Confirmed Booking are subject to specific terms and conditions of said third parties unrelated to AMIGO TOURS and their own specific policies may apply regarding additional charges for modifications, cancellations and refunds, special requests, missed flights, loss or misplacement of luggage, insurance, etc.

Although we will make our best efforts to inform You of any requirement or specific request that such third parties may require in order to enjoy the SERVICES that AMIGO TOURS has contracted for You by virtue of a Confirmed Booking associated with the SERVICES, we are not obligated to do so and we will not be liable to You for any lack of documentation or requirements to enjoy said SERVICES provided or operated by third parties unrelated to AMIGO TOURS, specifically and without limitation, those related to water, land or air transportation and hot air balloon travel experiences, access to venues, monuments, museums and parks.

FOURTH. PRICES. The rates of the SERVICES published on the Website are valid only on the day of quotation and are subject to change without prior notice. Depending on the country where the SERVICES are offered, prices may be expressed in pesos, legal tender of the United Mexican States, in dollars, legal tender of the United States of America, or in euros, legal tender in the European Union.

The rates of the SERVICES shown will only be guaranteed at the time the corresponding payment is received and when a Confirmed Booking is issued to You. All bookings are subject to availability. A booking is considered completed when You have a confirmation number and the corresponding charge to your credit or debit card has been applied.

FIFTH. COUPONS AND PROMOTIONS. Coupons, discount codes or promotions (hereinafter, “Coupons”) are promotional codes that offer discounts on the price of one or more SERVICES on the Website and have a limited validity, which will be indicated on the Coupon itself. Once the validity period has expired, the Coupon may not be used.

(a) Use of Coupons:

• Coupons may be used only once and are not transferable.• Coupons cannot be combined with other offers, promotions or discounts, unless expressly indicated otherwise.• To apply a Coupon, prior to payment of your service order, You must enter the Coupon code at the time of purchase on the Website. Failure to enter the Coupon prior to purchase will not entitle You to request any kind of bonus or refund on your Confirmed Booking, and AMIGO TOURS will not be obligated to apply the discount of any valid and legitimate Coupon that has not been duly entered prior to payment of a service order on the Website.

(b) Restrictions:

• Coupons have no cash value and cannot be redeemed for cash.• Coupons may not be used for previous or future purchases outside the validity period specified therein.• AMIGO TOURS reserves the right to cancel any Confirmed Booking if fraudulent or inappropriate use of the Coupons is detected.

(c) Modification and Cancellation of Coupons:

• AMIGO TOURS reserves the right to modify or cancel Coupons at any time without prior notice. In the event of modification, Coupons already issued will maintain their original conditions until their expiration date.• In the event of cancellation of the order by the user, the value of the Coupon will not be refunded and may not be reused.

(d) Limitations of Liability:

• AMIGO TOURS will not be liable to You for lost or stolen Coupons.• AMIGO TOURS does not guarantee that Coupons will be available at all times and we reserve the right to temporarily or permanently suspend the issuance of coupons.

SIXTH. CONTRACTING OF THE SERVICES. To contract any of the SERVICES offered through the Website, it will be sufficient to click on the dropdown tab identified as “Tours” and select the country where You wish to contract the SERVICES. Once You choose the country, a screen will appear with the different cities where AMIGO TOURS operates. Each specific city offers different types of SERVICES and experiences that will be displayed when You click on any city. Details and relevant information about each Service will be shown to You, as well as the option to book the Service of your preference and interest. Once You have chosen the Service You wish to contract, You may book it by clicking on the “Book Now” tab and choosing the available date and time that best suits You. Once the date and time of the SERVICES have been chosen, we will indicate the price per person and ask You to indicate whether You are going alone or with one or more companions, including specifying whether they are adults (over 12 years old), children (minors between 3 and 11 years old) or infants (under 3 years old). Once You have made the selection, an additional information section will be displayed, which is mandatory to complete and includes your name and the names of your companions, your identification number or passport number and those of your companions, your date of birth and those of your companions, a contact telephone number, as well as payment details.

Once the data has been entered, You declare under oath that said data and that of your companions is true, complete, correct and accurate, and You assume full responsibility regarding the data provided, releasing AMIGO TOURS from any liability for any refusal by third parties to provide, totally or partially, one or more SERVICES included in your Confirmed Booking. You understand that providing false, incorrect or inaccurate data (including those where You intend to obtain a price benefit by indicating different ages for your companions) may result in the non-provision or impossibility of providing the SERVICES and without the possibility of requesting a refund. AMIGO TOURS, at its sole discretion, may offer You a change of date for your Confirmed Booking but will not be obligated to do so, and You understand that such modification may involve penalties or extra expenses that You and your companions must cover.

SEVENTH. PAYMENT METHOD. The Website accepts Visa, MasterCard and American Express bank cards as a payment method. If You prefer to pay by bank transfer or another payment method accepted by AMIGO TOURS, contact the telephone service center in your country in the Contact section of the Website.

The amount corresponding to the booking will be charged immediately to your debit or credit card and we will send the Confirmed Booking to your email immediately, but in any case within 60 (sixty) minutes following the processing of the transaction. If You provided an email address by mistake, we ask You to contact us immediately providing the banking details in order to send the Confirmed Booking to your email address.

Rates shown in US dollars will be charged in US dollars and rates shown in euros will be charged in euros for transactions with Visa and Mastercard cards. You accept and understand that there may be fluctuations in the exchange rate of the issuer of your credit or debit card if it is not linked to US dollars or euros. AMIGO TOURS does not control this and is not responsible for it. Please contact your card issuer for more information in this regard.

Tips are not included in the price of the SERVICES unless indicated in the Confirmed Booking. Any optional service during the provision of the SERVICES that generates an additional extra expense and that is not stated as included in the total amount and is also not included free of charge by the final providers must be paid by You.

EIGHTH. MODIFICATIONS TO THE WEBSITE, SERVICES, DESTINATIONS AND PRICES. The prices of the SERVICES and other products that may be published on the Website are subject to change without any prior notice or notification from us. We reserve the right at any time to modify or discontinue one or more SERVICES (or any part of the Website content) at any time and at our sole discretion. We are not liable to You or any third party for modifications, price changes from one moment to another, suspension or interruptions of the SERVICES or the Website.

NINTH. DISCLAIMER REGARDING ILLUSTRATIVE IMAGES. The images used on the Website are merely illustrative and are intended to provide a general visual representation of tourist destinations. Although we make reasonable efforts to ensure that the images are accurate and updated, they may not faithfully reflect the current characteristics of the destinations, including seasonal changes, renovations or recent developments.

TENTH. DOCUMENTATION AND RELEASE OF LIABILITY FOR DENIAL OF ACCESS. AMIGO TOURS is not liable to You and/or your companions for denial of access to any country, tourist destination or for the use of the contracted SERVICES due to the lack of required documentation, such as passports, visas, official identifications or other necessary documents. It is the sole responsibility of You and your companions to ensure that, prior to the start of the SERVICES, You possess all documentation and comply with all relevant and valid requirements before using the SERVICES. AMIGO TOURS will make its best efforts to notify You in advance if your contracted SERVICE requires the presentation of certain specific documentation and will not be liable to You and/or your companions for denial of access to destinations or third-party locations. We strongly recommend that, prior to the start of the provision of the SERVICES, You review the documentation and other specific requirements (including without limitation, height, age or physical conditions, clothing, among others) in each jurisdiction, destination or place, including, without limitation, countries or regions, museums, monuments, churches, cathedrals, parks, ecological parks, recreational parks, wineries, factories, restaurants, squares, vessels, etc. Failure to comply with the documentation requirements may result in denial of entry to such places as well as the impossibility of adequately providing the SERVICES by AMIGO TOURS. AMIGO TOURS is not liable to You and your companions for any expense, inconvenience or loss, action or omission that may result from the denial of access due to the lack of adequate documentation by You and/or any of your companions.

ELEVENTH. DECLARATION OF CONSENT AND ASSUMPTION OF RISKS. By contracting one or more SERVICES through the Website, You declare under oath that You or You and your companions have adequate and sufficient personal insurance and/or medical insurance that covers any damage, accident or injury that may occur to You and/or your companions to your person or property during the execution of the SERVICES.

You and your companions understand that the SERVICES involve inherent risks that could result in injuries, illnesses, viruses or damages, including without limitation, traffic accidents, rollovers, falls, stings or bites (from land, marine or aerial animals), theft, assault, navigation accidents, drowning, adverse weather conditions and other known and unknown risks. Therefore, by contracting the SERVICES, You and your companions release AMIGO TOURS from all liability, claim, demand, action or damage of any kind or nature that may arise for You and/or your companions related to your participation in the SERVICES due to any risk inherent thereto that may result in injuries, illnesses or damages, including without limitation, traffic accidents, rollovers, falls, stings or bites (from land, marine or aerial animals), theft, assault, navigation accidents, drowning, adverse weather conditions and other known and unknown risks, and You and/or your companions will assume financial responsibility for any cost, damage or injury that You may experience during your participation in the contracted SERVICES.

TWELFTH. VACCINATION AND ALLERGIES. Without prejudice to the requirements of the authorities, AMIGO TOURS will not require You to have prior vaccinations to use the SERVICES. We understand that the health and safety of You and your companions are of utmost importance. However, at this time, we do not require or verify the vaccination status of our clients before they use our SERVICES. We strongly recommend that You and your companions follow the public health guidelines and those recommended by your primary physician that You consider relevant prior to using the SERVICES, but the decision to be vaccinated or not remains at the personal discretion of each individual.

By accepting and using our SERVICES, You and your companions understand and accept that AMIGO TOURS will not assume any responsibility in relation to the lack of specific vaccinations and/or the occurrence of allergies that may happen to You and/or any of your companions during the SERVICES, nor for any consequence derived from your decision not to be vaccinated prior to using the SERVICES. You and your companions understand that due to the inherent risks of the SERVICES, they may result in direct contact with nature and certain poisonous or allergenic elements or organisms for You and/or your companions, including stings or bites from wild animals or otherwise, and therefore You and your companions assume all responsibility for your own health and well-being during the use of our SERVICES. We strongly recommend contacting a specialized local physician prior to using the SERVICES to learn about the risks to which You and your companions may be exposed in the use of the SERVICES and the vaccines or protections that may be required to avoid any allergy or exposure to poisonous elements, animals or organisms. If You or any of your companions is allergic to any specific animal, substance or organism of nature at the destination where You intend to contract the SERVICES, we recommend that You do not do so.

THIRTEENTH. PHYSICAL CAPABILITIES. You declare under oath that You and your companions have adequate physical capacity and are in good health to participate in any activity of the contracted SERVICES and that You do not have medical conditions or physical limitations that could be aggravated by the participation of You and/or your companions in physical, water or land activities. If You or any of your companions has any known or unknown limitation to perform any activity of the SERVICES, we suggest that You do not contract the SERVICE and, in the event of contracting it and using the SERVICES with such known or unknown limitations, You and your companions release AMIGO TOURS from all liability, claim, demand, action, damage or injuries of any kind or nature that may arise for You and/or your companions related to your participation in the SERVICES, and You and/or your companions will assume financial responsibility for any cost, damage or injuries that You may experience during your participation in the contracted SERVICES.

FOURTEENTH. USE OF EQUIPMENT. You and your companions undertake to use all safety equipment provided and to strictly follow the instructions of AMIGO TOURS guides and staff during the activities of the contracted SERVICES.

FIFTEENTH. CONSENT FOR MEDICAL CARE. In the event that You (or any of your companions or any of the third-party beneficiaries of the SERVICES for whom You contracted the SERVICES in their name and for their benefit) suffer any kind of emergency, allergy, condition, sting, bite or accident during the SERVICES that is not a road accident that may occur during the journey while inside a vehicle or bus, in which case the provisions of Clause Twenty-Second shall apply, You (including your companions or the third-party beneficiaries of the SERVICES for whom You contracted the SERVICES in their name and for their benefit) authorize AMIGO TOURS and/or the guides assigned to the SERVICES to organize the medical care necessary to address it and expressly accept being responsible for the costs associated with such care, including without limitation, the request for local medical service from the museum, attraction, location, park, place or site being visited and/or public or private assistance from medical or ambulance services (land, air or water). To the extent circumstances allow, and in the judgment of AMIGO TOURS and/or the guides assigned to the SERVICES, the health or safety of You (including that of your companions or the third-party beneficiaries of the SERVICES for whom You contracted the SERVICES in their name and for their benefit) is not compromised or further compromised and circumstances are possible for AMIGO TOURS and/or the guides assigned to the SERVICES, we may provide basic first aid care and transportation of You (or that of your companions or the third-party beneficiaries of the SERVICES for whom You contracted the SERVICES in their name and for their benefit who have suffered an accident) to the nearest hospital or medical center at no cost.

SIXTEENTH. CLAIMS. Once the SERVICES under a Confirmed Booking have been enjoyed, any complaint, disagreement and/or clarification must be made in writing, addressed to AMIGO TOURS.

You and your companions understand and accept that the SERVICES contracted under a Confirmed Booking are contracted under an integral service provision scheme that does not give rise to partial divisions thereof, and You understand that no refund will be made for SERVICES voluntarily and partially unused by You (including your companions or the third-party beneficiaries of the SERVICES for whom You contracted the SERVICES in their name and for their benefit) contained and contracted in a Confirmed Booking.

In the event that You have contracted directly with individuals or legal entities through websites owned by third parties or any other means or platform unrelated to the Website, one or more SERVICES offered/operated/managed by AMIGO TOURS, You expressly accept that any claim must be handled directly with said individuals or legal entities. When You select and contract a SERVICE operated, managed and/or administered by AMIGO TOURS on third-party sites or platforms, You are contracting directly with said third parties and AMIGO TOURS acts as a commercial agent for said third party, therefore You release AMIGO TOURS from any liability in this regard.

In the event that any of the SERVICES operated by third-party individuals or legal entities unrelated to AMIGO TOURS under a Confirmed Booking are not provided due to cause attributable to or unjustified refusal by said third parties and You must seek or contract them on your own and at your own expense, we ask You to request the necessary payment receipts so that AMIGO TOURS may manage the refund in full. If there is no receipt, the admissibility of the refund will be subject to prior analysis of the specific case by AMIGO TOURS and will be carried out according to the initial payment method and the third party’s policies. Please note that this will not apply when the refusal of said third party to provide the SERVICES operated by third parties is a consequence of the total or partial failure by You and/or any of your companions to comply with any of the provisions of these Terms and Conditions, with the terms and conditions and policies of said third parties, due to false statements made by You at the time of booking, due to missed flights, transportation or experiences, due to not being dressed appropriately, due to disturbing public order or any other cause.

SEVENTEENTH. CANCELLATIONS, MODIFICATIONS AND SPECIFICATIONS. For modifications, cancellations or additional requests to your Confirmed Booking, please refer to the General Booking Cancellation and Refund Policy published on the Website.

EIGHTEENTH. NO EMPLOYMENT RELATIONSHIP. If You are an individual or legal entity that has contracted one or more SERVICES through the Website in the name and on behalf of third-party beneficiaries of the SERVICES, or if You are a service provider that maintains a contractual relationship with AMIGO TOURS to provide any of the SERVICES, You expressly agree that such relationship does not create any kind of association, partnership or employment relationship between You and AMIGO TOURS, nor with its shareholders, employees, officers, factors or dependents, and therefore each of the parties shall be solely responsible for its obligations derived from legal provisions and other regulations regarding labor and social security. You and AMIGO TOURS are independent contracting parties and no provision included in the Confirmed Booking shall make either party an agent or legal representative of the other for any purpose whatsoever, nor shall it grant either party any authority to assume or create any obligation on behalf of or in the name of the other.

NINETEENTH. LICENSE OF USE AND INDUSTRIAL AND INTELLECTUAL PROPERTY. AMIGO TOURS grants You a worldwide, limited, non-exclusive, non-transferable and revocable license of use to access and use the Website for the sole and exclusive purpose of contracting any of the SERVICES offered through it by AMIGO TOURS (the “License of Use”).

Restrictions on the License of Use. When using the Website, You may not:

(a) Modify, adapt, translate or create derivative works from the Website.(b) Reproduce, duplicate, copy, sell, resell or otherwise exploit for commercial purposes any part of the Website.(c) Use framing techniques to attach any trademark, logo or any other information owned by AMIGO TOURS (including images, text, page design or form) without the express written consent of AMIGO TOURS.(d) Collect information from the Website through the use of any automated means (including scripts, bots, crawlers or scrapers).

The Website and all its content, including but not limited to text, graphics, images, logos, icons and software, are the exclusive property of AMIGO TOURS or its licensors and are protected by applicable intellectual property laws. Nothing in this agreement shall be interpreted as a transfer of intellectual property rights to You.

AMIGO TOURS reserves the right to terminate this license at any time and restrict your access or the provision of the SERVICES without any liability and for any reason, without prior notice. In the event of termination, You must immediately cease using the Website.

AMIGO TOURS will not be liable to You for any indirect, incidental, special, consequential or punitive damage arising from the use of the Website.

Under no circumstances may You use or exploit for your benefit the trademarks, commercial notices or any other intellectual property rights belonging to AMIGO TOURS and/or contained on the Website, and therefore You will be responsible for any civil, administrative or criminal sanctions resulting from the violation of the aforementioned industrial and intellectual property rights.

TWENTIETH. PERSONAL DATA PROTECTION. For matters related to how AMIGO TOURS handles and protects your personal data, please refer to the Privacy Notice published on the Website if You are located in Mexico and to the Privacy Policy if You are located in the European Union or in any country other than Mexico.

TWENTY-FIRST. ASSIGNMENT OF IMAGE USE RIGHTS AND CONSENT FOR PHOTOGRAPHIC AND/OR VIDEO RECORDING.

(a) Consent through the contracting of the SERVICES. By contracting any of the SERVICES through the Website and obtaining a Confirmed Booking, You (including your companions or the third-party beneficiaries of the SERVICES for whom You contract in their name and for their benefit) acknowledge, accept and expressly consent that during the development of the SERVICES You may be captured in photographs and/or video recordings made by AMIGO TOURS, its employees, guides, subcontractors, local operators or business partners.

(b) Purpose of the captures. Such photographs and/or video recordings may be used by AMIGO TOURS, its subsidiaries and/or affiliates, for promotional, advertising, marketing, commercial, internal training, experience improvement purposes, dissemination on social networks (including, without limitation, Facebook, Instagram, TikTok, YouTube, X, LinkedIn), as well as for inclusion on the Website, in catalogs, brochures, printed or digital materials, corporate presentations or any other activity related to AMIGO TOURS’ corporate purpose.

(c) Free nature and duration. This authorization is granted free of charge, voluntarily and for an indefinite period, without You or your companions having the right to receive any consideration, royalty, compensation or payment for such use.

(d) Right of opposition expressed at the start of the SERVICE. If You or any of your companions does not wish to be photographed and/or video recorded, or does not wish for their image to be used as provided in these Terms and Conditions, this must be expressly stated to the guide, representative or AMIGO TOURS staff assigned to the SERVICE before the start of its provision. Such statement will be recorded by AMIGO TOURS and, to the extent operationally possible, reasonable efforts will be made to avoid capturing the image of the person who has objected. AMIGO TOURS will not be responsible for involuntary, accidental or general group captures where the objecting person appears in non-individualizable collective shots, provided that reasonable efforts have been made to avoid it.

(e) Right of subsequent removal (revocation). In the event that, notwithstanding the foregoing, AMIGO TOURS or its subcontractors have captured images of You or your companions without express opposition having been made at the start of the SERVICE, or if, having objected at the start, such images were published by mistake, You or your companions may request the removal, de-indexing, deletion or blocking of the content in which your image appears, or of the part of the content where your image is recognizable, by sending an email to: dataprotection@amigotours.com. AMIGO TOURS will address such request within a reasonable period, not exceeding 15 (fifteen) business days counted from receipt of the email, provided that the request precisely identifies the SERVICE, the date, the location and, if possible, the specific link or reference of the published material.

(f) Limitation of removal. AMIGO TOURS will not be obligated to remove promotional, advertising or marketing materials that have already been physically distributed (printed) or published on third-party channels outside its direct control, provided that such distribution or publication occurred before receipt of the removal request. In these cases, AMIGO TOURS will cease using said images in future campaigns or materials.

(g) Obligation to inform companions. You declare under oath that You have informed and/or will inform all your companions, as well as the third-party beneficiaries of the SERVICES for whom You contract in their name and for their benefit, about the possibility of being photographed and/or video recorded pursuant to this clause, as well as about their right to object at the start of the SERVICE and to request subsequent removal under the terms provided herein. You assume full responsibility for the failure to provide such information to your companions or third-party beneficiaries, releasing AMIGO TOURS from any claim that said persons may file for the use of their image under the terms of this clause, unless they have timely exercised their right of opposition pursuant to subsection (d) above.

(h) Use of the image of minors. If any of your companions is a minor or does not have the legal capacity to grant this consent by themselves, You declare under oath that You are their father, mother, legal guardian or authorized representative, and that You have sufficient parental authority, guardianship or authorization to grant consent on their behalf. If this is not the case, You undertake not to include said minor in the SERVICE and not to provide their data. AMIGO TOURS reserves the right to request proof of such representation.

(i) Survival. The obligations and rights provided in this clause shall survive even after the termination or rescission of the contractual relationship between You and AMIGO TOURS, for any reason.

TWENTY-SECOND. FORTUITOUS EVENT AND FORCE MAJEURE. You understand and expressly agree that AMIGO TOURS will not be liable to You and your companions for any impossibility of providing the SERVICES totally or partially when such impediment results from a fortuitous event or force majeure such as hurricane, closed port, excessive traffic, blockades, administrative decisions of places and museums, floods, muddy or blocked roads, tropical storms, epidemics, pandemics or any other natural or man-made phenomenon unrelated to AMIGO TOURS. In these cases, only the date change policy of your Confirmed Booking will apply and, on a case-by-case basis and at AMIGO TOURS’ sole discretion, a total or partial refund of the Confirmed Booking may apply.

TWENTY-THIRD. INSURANCE. AMIGO TOURS, or if applicable, the independent transportation service providers contracted by AMIGO TOURS to provide You with the SERVICES, maintain a general traveler insurance policy, which covers You (including your companions or the third-party beneficiaries of the SERVICES for whom You contracted the SERVICES in their name and for their benefit) during transfers inside the vehicle or bus to any location contracted in the Confirmed Booking. Therefore, You (including your companions or the third-party beneficiaries of the SERVICES for whom You contracted the SERVICES in their name and for their benefit) expressly accept and acknowledge that its coverage applies only during journeys inside vehicles or buses. AMIGO TOURS may provide You with a copy of it if You so request.

TWENTY-FOURTH. RELEASE OF LIABILITY FOR PERSONAL OPINIONS ON SOCIAL NETWORKS AND OTHER INTERNET SITES. The opinions, comments and ratings about our SERVICES shown on the Website or expressed by users on social networks or any other online platform are exclusively personal opinions of said users and we assume no responsibility or obligation to You and your companions in this regard. These opinions are merely informative and do not necessarily reflect our official position, policy or point of view. We assume no responsibility for any false expectation regarding the SERVICES derived from an opinion of other users of the SERVICES. We urge users of our SERVICES to make respectful and truthful comments, avoiding defamation, slander or any other content that may be considered offensive, illegal, inaccurate or false.

TWENTY-FIFTH. MODIFICATIONS AND UPDATES TO THE TERMS AND CONDITIONS. AMIGO TOURS may modify, expand, remove, correct or update these Terms and Conditions at any time and at its sole discretion. In all cases, we will publish on the Website the date of the latest update of these Terms and Conditions and such date, for all legal purposes that may apply, will be considered the date of the current Terms and Conditions associated with the SERVICES and applicable to any Confirmed Booking.

We may also communicate these changes through the Website by means of pop-up messages or windows or by sending an email to You if we have your address, but without being obligated to do so.

TWENTY-SIXTH. REGULATORY COMPLIANCE BY JURISDICTION. AMIGO TOURS and its affiliates, as well as each of the entities that provide the SERVICES through the Website according to the applicable jurisdiction (Operadora Arozarena, S.A. de C.V. in Mexico; Amigo Group Europa, S.L. in Spain; Amigo Tours New York, LLC in the United States; Amigo Tours LTD in the United Kingdom; as well as the entities operating in Ireland, Japan, Italy, the Netherlands, France, Germany and Austria), undertake to comply with all applicable laws, regulations and provisions in each of said jurisdictions in relation to the provision of the SERVICES, the operation of the Website, consumer protection, e-commerce, personal data protection, tourism, package travel, passenger transportation and any other relevant matter.

In particular, and without limitation, AMIGO TOURS complies with:

• Mexico: Federal Consumer Protection Law, Federal Law on the Protection of Personal Data Held by Private Parties, Federal Civil Code regarding the provision of tourist services, and provisions of the Ministry of Tourism (SECTUR).

• United States: Federal Trade Commission (FTC) regulations, Americans with Disabilities Act (ADA) applicable to tourist services, and state consumer protection laws.

• Spain: Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE), Royal Decree-Law 23/2018 on package travel, Organic Law 3/2018 on Personal Data Protection and guarantee of digital rights.

• Japan: Japanese Consumer Contract Act, Act on Specified Commercial Transactions, Travel Agency Act (Law No. 239 of 1952), and Act on the Protection of Personal Information (APPI).

AMIGO TOURS undertakes to keep its operational practices, cancellation policies, privacy notices and customer service mechanisms updated in order to comply at all times with the legal requirements in force in each of the countries where it offers SERVICES. The fact that a SERVICE is provided in a specific country does not imply that AMIGO TOURS must comply with all the laws of all the listed countries, but only with those that are applicable according to the place where the SERVICE is provided, the domicile of the contracting entity and the consumer protection legislation applicable to the user in accordance with the applicable conflict-of-law rules.

This clause does not grant You or your companions any additional rights beyond those already recognized by the laws applicable to your specific case, and its sole purpose is to inform about AMIGO TOURS’ commitment to regulatory compliance.

TWENTY-SEVENTH. APPLICABLE LAW AND JURISDICTION. The applicable law and jurisdiction for any dispute or controversy arising from or in relation to these Terms and Conditions and the SERVICES, and the courts that have exclusive jurisdiction to resolve any dispute or controversy between You and your companions and AMIGO TOURS, shall be determined by the place where the domicile of the AMIGO TOURS entity is located, to which You and your companions agree to submit:

The consent granted by You (including your companions or the third-party beneficiaries of the SERVICES for whom You contracted the SERVICES in their name and for their benefit) at the time of contracting any of the SERVICES through the Website represents the full acceptance and express consent of You (including your companions or the third-party beneficiaries of the SERVICES for whom You contracted the SERVICES in their name and for their benefit) to these Terms and Conditions. In the event that a handwritten signature on the document is not possible due to the use of electronic and/or technological means, the full and total consent and acceptance of You (including your companions or the third-party beneficiaries of the SERVICES for whom You contracted the SERVICES in their name and for their benefit) shall be understood to be undoubtedly expressed from the moment You click on the section accepting these Terms and Conditions, make the payment for your booking and AMIGO TOURS issues You a Confirmed Booking.
